Legislation made easy

The interpretation and application of the NSW Work Health and Safety (WHS) legislation can be challenging for NSW Home and Community Care (HACC) service providers who deploy a workforce into client homes. 

Duties of persons conducting a business or undertaking (PCBU) and workers extend to all environments within which work is carried out, including client homes.  Under WHS legislation, workers includes all persons conducting work for the PCBU in the workplace, including employees, contractors, sub-contractors, labour hire, students/work experience and volunteers. 

HACC service providers are not only required to meet their responsibilities under the NSW WHS legislation but also the obligations of other legislation as relevant to the services they provide.  

This section provides a series of plain English fact sheets that interpret the NSW WHS legislation for the HACC context and includes the interplay with other pieces of legislation.
